These Terms & Conditions govern purchases made through miauoriginals.com.

Please read them carefully before placing an order. By placing an order through our website, you agree to these Terms & Conditions and to the policies referred to below.

2. SCOPE OF THESE TERMS

These Terms apply to products purchased through miauoriginals.com.

Where you are purchasing as a consumer, nothing in these Terms limits or excludes any mandatory rights granted to you by applicable consumer-protection law.

If you purchase products primarily for purposes relating to your trade, business, craft or profession, certain consumer-specific rights described in these Terms may not apply.

3. WHO CAN PLACE AN ORDER?

To place an order, you must have the legal capacity to enter into a binding contract.

By placing an order, you confirm that the information you provide is accurate, complete and up to date.

If customer accounts are available on the website, you are responsible for keeping your login information confidential and for notifying us if you believe that your account has been accessed without authorisation.

Creating an account is not a condition of purchase unless expressly indicated during checkout.

4. PRODUCTS

We make reasonable efforts to display and describe our products as accurately as possible.

Product pages include the main characteristics, available sizes, colours and other relevant information relating to each item.

Please note that colours and patterns may appear slightly different depending on the screen, device and display settings used to view the website.

Minor variations that do not affect the essential characteristics or conformity of the product may occur.

Nothing in this section affects your statutory rights where a product is faulty, incorrect or does not conform to its description.

5. PRODUCT AVAILABILITY

All orders are subject to product availability.

Adding an item to your cart does not reserve that item.

If a product becomes unavailable after you place an order, we will contact you as soon as reasonably possible.

Depending on the circumstances, you may be offered an alternative where appropriate, or the unavailable item or order will be cancelled and any corresponding payment refunded.

We will never substitute an unavailable product with a different product without your agreement.

6. PRICES

Prices are displayed in euros (€) unless otherwise indicated.

Applicable taxes are calculated and displayed according to the delivery destination and the tax treatment applicable to the order.

Shipping costs are not included in the product price unless expressly stated otherwise.

Available shipping methods and the exact shipping cost applicable to your order will be displayed at checkout before payment.

For deliveries outside the European Union, customs duties, import taxes or other local charges may apply. Please see our Shipping Policy for further information.

7. PRICING ERRORS

We take reasonable care to ensure that prices displayed on the website are correct.

If we identify an obvious pricing or technical error before accepting your order, we may contact you to offer you the opportunity to purchase the product at the correct price or cancel the affected item.

You are not required to proceed with an order at a corrected higher price.

If an affected payment has already been collected and the order is cancelled, the relevant amount will be refunded.

8. PLACING AN ORDER

To purchase a product, select the item and size you wish to buy, add it to your cart and follow the checkout process.

Before submitting your order, you will have the opportunity to review the information entered, including the products selected, delivery details, shipping method and price.

It is your responsibility to check that this information is correct before completing the order.

By activating the final payment or order button, you acknowledge that the order involves an obligation to pay.

After placing your order, you will receive an email confirming that we have received it.

This acknowledgement does not necessarily mean that your order has been accepted.

The purchase contract is concluded when MÏAU confirms acceptance of your order, including through an order or shipping confirmation, as applicable.

If we are unable to accept an order, we will inform you and refund any amount already collected for the affected order.

9. WHEN WE MAY REFUSE OR CANCEL AN ORDER

We may refuse or cancel an order before dispatch where there is a legitimate reason to do so, including where:

  • the product is unavailable;

  • payment has not been authorised;

  • the information provided for the order is materially incomplete or incorrect;

  • we reasonably suspect fraud or unauthorised payment activity;

  • a clear pricing or technical error has occurred; or

  • we cannot legally or operationally deliver the order to the destination provided.

We will not cancel orders arbitrarily.

If payment has already been collected for an order we cannot accept, the applicable amount will be refunded.

10. PAYMENT

The payment methods currently available will be displayed at checkout.

Depending on availability, these may include payment cards and other electronic payment methods provided through our ecommerce and payment-service providers.

Payment methods are subject to authorisation by the relevant payment provider.

If payment is refused or cannot be authorised, the order may not be completed.

MÏAU does not generally receive or store complete payment card details. Payments are processed through authorised payment-service providers using the security measures applicable to their services.

The final amount payable, including any applicable taxes and shipping charges, will be displayed before you confirm the order.

11. ORDER CONFIRMATION

After an order has been successfully submitted, we will send confirmation to the email address provided during checkout.

Please check your order confirmation carefully and contact us promptly at:

We recommend keeping the order confirmation for your records.

Where applicable, invoices or other purchase documentation may be issued electronically.

12. CHANGES & CANCELLATIONS BEFORE DISPATCH

If you wish to change or cancel an order after placing it, contact us as soon as possible at:

We will do our best to accommodate your request, but we cannot guarantee that an order can be changed or cancelled once it has entered the preparation or dispatch process.

This does not affect any statutory right of withdrawal or other consumer rights that may apply after delivery.

13. SHIPPING & DELIVERY

Shipping destinations, available methods and applicable costs are determined during checkout.

Estimated delivery times may vary according to destination and shipping method.

Unless another delivery period has been specifically agreed, orders will be delivered in accordance with the time limits required by applicable consumer law.

The risk of loss or damage generally remains with MÏAU until you, or a person designated by you, take physical possession of the goods, except where applicable law provides otherwise.

14. RIGHT OF WITHDRAWAL & RETURNS

If you purchase online as a consumer, you generally have a statutory right to withdraw from the contract within 14 calendar days of receiving the goods, subject to the exceptions established by law.

You may also use the model withdrawal form provided in our Returns & Refunds Policy or any online withdrawal function made available through our website.

Nothing in these Terms restricts any additional statutory rights you may have.

15. HYGIENE & PERSONALISED PRODUCTS

Certain products may be excluded from the statutory right of withdrawal where the legal requirements for an exception are met.

This may include:

  • sealed goods that are unsuitable for return for health protection or hygiene reasons once unsealed after delivery; and

  • goods made to the consumer’s specifications or clearly personalised.

Any applicable exclusion will be interpreted in accordance with consumer law and does not affect your rights where a product is faulty, damaged, incorrect or otherwise non-conforming.

16. REFUNDS

Where a refund is due, it will normally be made using the same payment method used for the original transaction unless another method has been expressly agreed.

The timing and scope of refunds depend on the reason for the refund and are explained in our Returns & Refunds Policy.

Where you validly exercise your statutory right of withdrawal, applicable refunds will be made in accordance with the time limits required by consumer law.

17. LEGAL GUARANTEE & PRODUCT CONFORMITY

MÏAU is responsible for ensuring that the goods supplied conform to the sales contract.

For consumer purchases of new goods in Spain, MÏAU is responsible for lack of conformity that exists at the time of delivery and becomes apparent within the statutory period applicable under Spanish consumer law.

At present, that period is three years from delivery for goods.

Where a product is non-conforming, you may be entitled, depending on the circumstances and applicable law, to appropriate remedies such as repair, replacement, a price reduction or termination of the contract and refund.

Statutory remedies will be provided without charge where required by law.

These statutory rights are separate from any voluntary commercial guarantee that might occasionally be offered with a product.

18. PROMOTIONS & DISCOUNT CODES

From time to time, MÏAU may offer promotional prices, discount codes or other special offers.

Any additional conditions applicable to a promotion will be communicated with the offer.

Unless otherwise stated, promotional codes:

  • must be used within their stated validity period;

  • cannot be exchanged for cash;

  • may be subject to product or order restrictions; and

  • may not be combined with other offers.

MÏAU may refuse fraudulent, unauthorised or abusive use of a promotional code.

Promotional conditions do not affect statutory consumer rights.

19. GIFT CARDS

Where MÏAU gift cards are available, any specific validity, redemption or usage conditions will be communicated at the time of purchase or on the relevant product page.

Gift cards cannot be exchanged for cash except where required by applicable law.

Nothing in any gift-card conditions limits mandatory consumer rights.

20. LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability arising from mandatory consumer-protection rules.

MÏAU is not responsible for losses caused solely by circumstances outside our reasonable control where applicable law permits such limitation.

We are also not responsible for damage resulting from the improper use of a product contrary to its intended purpose or care instructions, except where liability cannot legally be excluded.

For consumers, we do not exclude liability for rights or remedies relating to defective or non-conforming products where those rights are provided by law.

21. EVENTS OUTSIDE OUR REASONABLE CONTROL

Occasionally, events outside our reasonable control may affect our ability to process or deliver an order.

These may include serious transport disruption, natural events, public-authority measures, telecommunications failures, major technical incidents or other exceptional circumstances.

Where such an event occurs, we will take reasonable steps to minimise its effects and keep you informed where the performance of your order is materially affected.

Nothing in this section removes any mandatory right you may have under applicable consumer law.

Information may be shared with payment, logistics, technology and other providers where necessary to process and fulfil your order or where otherwise permitted by law.

We aim to resolve complaints directly and as efficiently as possible.

Where applicable, consumers may also have access to competent consumer authorities or recognised alternative dispute-resolution mechanisms in accordance with applicable law.

24. CHANGES TO THESE TERMS

We may update these Terms & Conditions from time to time to reflect changes to our services, website, business practices or applicable law.

The version applicable to your purchase is the version in force when you place your order.

Changes made after an order has been concluded will not retrospectively alter the contractual terms applicable to that order.

The date at the top of this page indicates when these Terms were last updated.

25. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the extent necessary under applicable law.

The remaining provisions will continue to apply.

26. APPLICABLE LAW & JURISDICTION

These Terms and contracts concluded through miauoriginals.com are governed by Spanish law, without prejudice to mandatory consumer rights that may apply under European Union law or the law of the consumer’s country of residence.

Where the customer acts as a consumer, disputes will be subject to the courts determined by applicable consumer-protection and procedural law.

Nothing in these Terms requires a consumer to bring proceedings before a court other than one to which they are entitled under mandatory law.
